Obtaining a Divorce

Even if you and your spouse have already separated, you will still need to obtain a divorce from the court to formally end the marriage, and to obtain other court orders to finalise financial and property claims with your spouse.

We now have “no fault divorce” in England and Wales (since April 2022). Provided you have been married for at least one year, the only legal requirement to obtain a divorce is a statement that the marriage has permanently broken down.

The application for divorce is made electronically via the court “portal” and neither you nor your spouse will be required to attend court in person at any stage. The whole process usually takes around 6-9 months from start to finish, which includes a compulsory waiting period of 20 weeks between the Conditional Order and the Final Order being made.
